Terms of Service

1. Acceptance of Terms

By accessing or using the BookerAI platform ("Service"), you agree to be bound by these Terms. If you do not agree, you may not use the Service.

2. Description of Service

BookerAI provides a scheduling and booking platform for independent service providers ("Providers"). We are a technology platform, not a service provider.

3. Eligibility

You must be at least 18 years old to use this Service. By creating an account, you represent that you are of legal age.

4. Account Responsibility

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

5. Provider Responsibilities

Providers are independent contractors and not employees of BookerAI. Providers are solely responsible for:

• Setting their own pricing, services, and policies.
• Complying with all applicable laws and regulations.
• Handling all tax obligations.

6. Client Responsibilities

Clients are responsible for their own bookings and adhering to the cancellation policies set by Providers.

7. Cancellations and Refunds

Cancellation policies and refunds for services booked through Providers are determined by the individual Provider. BookerAI does not manage or issue refunds for services rendered by Providers.

For BookerAI Premium subscription refunds, please refer to Section 8 below.

8. Subscriptions and Payments

8.1 BookerAI Premium Subscription

BookerAI offers a Premium subscription plan ("BookerAI Pro") that provides access to enhanced features including advanced dashboard, photo gallery, dark mode, and priority support.

8.2 Subscription Pricing and Billing

BookerAI Pro is offered as a monthly auto-renewable subscription. The current subscription price is displayed at the time of purchase. Prices may vary by region and are subject to change with notice.

8.3 Auto-Renewal

Your BookerAI Pro subscription will automatically renew each month unless you cancel at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price you originally purchased unless the price has changed, in which case you will be notified in advance.

8.4 Payment via Apple In-App Purchase (iOS)

If you subscribe through the BookerAI iOS app, payment is processed through Apple's In-App Purchase system. By subscribing:

• Payment will be charged to your Apple ID account at the confirmation of purchase.
• Your subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period.
• Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period.
• You can manage and cancel your subscriptions by going to your Apple ID Account Settings > Subscriptions after purchase.
• Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription.

All payments made through Apple In-App Purchase are subject to Apple's terms and conditions. Refund requests for iOS subscriptions must be directed to Apple through their Report a Problem page.

8.5 Payment via Stripe (Web and Android)

If you subscribe through the BookerAI website or Android app, payment is processed securely via Stripe. BookerAI does not store full credit card details on its servers. For refund requests for Stripe-processed payments, please contact us at support@bookerai.com.

8.6 Cancellation

You may cancel your subscription at any time:

• iOS: Go to Settings > [Your Name] > Subscriptions > BookerAI Pro > Cancel Subscription.
• Web/Android: Go to Settings > Manage Subscription within the BookerAI app, or contact support@bookerai.com.

Upon cancellation, you will retain access to Premium features until the end of your current billing period. No partial refunds are issued for the remaining days in a billing cycle.

8.7 Free Plan

BookerAI also offers a free plan with limited features. No payment is required for the free plan.

9. Communications Consent

By using the Service, you consent to receive communications, including emails, SMS, and push notifications, related to your bookings and account updates. Message and data rates may apply.

10. AI Disclaimer

AI-assisted scheduling features are provided "as is" and may not be 100% accurate. Users should verify all booking details.

11. Prohibited Use

You agree not to use the Service for any unlawful purpose or to violate any laws in your jurisdiction.

12. Intellectual Property

The BookerAI platform and its original content, features, and functionality are owned by BookerAI and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

13. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. BookerAI makes no representations or warranties of any kind, express or implied.

14. Limitation of Liability

In no event shall BookerAI be liable for any indirect, incidental, special, consequential or punitive damages.

15. Arbitration and Class Action Waiver

Any disputes arising from these Terms shall be resolved through binding arbitration. You waive any right to participate in a class-action lawsuit.

16. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

17. Governing Law

These Terms shall be governed by the laws of the United States and the State of Texas.
